Welcome to You Were There ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of the You Were There mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years old (or 16 in the European Union) and that you agree to these Terms. If you do not agree, you must not use the App.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits & Payments

• The App uses a credit-based system. Each AI photo generation consumes credits.
• Free credits may be provided upon registration, through weekly bonuses, or referral rewards.
• Additional credits can be purchased through in-app purchases via the Apple App Store or Google Play Store.
• All purchases are final. Refunds for in-app purchases are handled exclusively by Apple or Google according to their respective refund policies.
• We reserve the right to modify credit pricing, bonus amounts, and the credit system at any time.

4. Acceptable Use

You agree not to use the App to:

• Create deepfakes or content intended to deceive others into believing a fabricated scenario is real
• Generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Impersonate real people, celebrities, or public figures in misleading ways
• Create nudity, sexual content, or pornographic material
• Generate content promoting hate, violence, discrimination, or terrorism
• Infringe on the intellectual property rights of others
• Use the App for any commercial purpose without our prior written consent
• Attempt to reverse-engineer, hack, or exploit the App or its systems

Violations may result in immediate suspension or termination of your account without refund.

5. Content Ownership

• You retain all rights to the original photos you upload to the App.
• By uploading photos, you grant us a limited, non-exclusive license to process them solely for the purpose of providing the AI generation service.
• AI-generated images created through the App are yours to use for personal, non-commercial purposes.
• If you submit content to the public Showcase, you grant us a license to display it within the App.

6. AI-Generated Content

• AI-generated images are created by artificial intelligence and may not be historically accurate or photorealistic in all cases.
• We do not guarantee specific results, quality levels, or accuracy of generated content.
• Generated content should be understood as creative and entertainment-oriented, not factual representations.
• You are solely responsible for how you use and share AI-generated content.

7. Moderation & Suspension

• We reserve the right to review, moderate, and remove any content that violates these Terms.
• We may issue warnings, temporary suspensions, or permanent bans for violations.
• A strike system is in place: repeated violations will result in escalating consequences.
• We may take action based on automated detection systems or manual review.
• Account suspension or termination decisions are at our sole discretion.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
• We are not responsible for any loss of data, photos, or credits due to technical issues beyond our reasonable control.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Italy.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
